INDEPENDENT CONTRACTORS VS. EMPLOYEES
It is also of great importance to know that an experienced company is in complete compliance with federal, state and local regulations. Did you know that if the agency that offers you homehelp isn't paying their staff as employees but rather as independent contractors then the onus is on YOU to provide both them and the government with 1099 tax information and potentially assumer responsibiliyt for payroll taxes? Of course you may not consider this relevent until the President appoints you to a Cabinet position that requires a Senate confirmation hearing, however if the agency you are hiring is relying on YOU to assume responsibility for these tax issues, what provision are they making for insurance? Ask potential agencies about their levels of liability and worker's comp insurance; it's a clear sign of whether the agency you will be working with is investing in protecting clients and workers alike.
Remember, Massachusetts law changed in 2004 to close an IRS exemption that allowed child-care professionals to work as Independent Contractors. Having Independent Contractors work for you might save in the short-term but may put you at risk of facing payroll taxes and penalties from Federal and State governments if it is determined that you did not remit payroll taxes on time.
